MORTGAGE A legal document by which real property is pledged as security for the repayment of a loan. USURY Interest charged in excess of the legal rate established by law. SURVEY A measurement of land, prepared by a licensed surveyor, showing a property's boundaries, elevations, improvements, and relationship to surrounding tracts. TRUTH-IN-LENDING ACT Federal law requiring written disclosure of the terms of a mortgage (including the APR and other charges) by a lender to a borrower after application. Also requires the right to rescission period. DUPLEX A structure that provides housing accommodations for two families by having separate entrances, kitchens, bedrooms, lanais, living rooms and bathrooms. A two-family dwelling. RETALIATORY EVICTION An act whereby a landlord evicts the tenant in response to some complaint made by the tenant. PARTIAL RELEASE A clause found in a mortgage which directs the mortgagee to release certain parcels from the lien of the blanket mortgage upon the payment of a certain sum of money. |
